1. Agreement to Terms

By accessing or using the Leadfrack platform operated by Pixel Pantry Technology, Inc. ("Leadfrack," "we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you may not use our service.

2. Description of Service

Leadfrack provides AI-powered sales tools for direct-to-consumer (DTC) brands, including inbox monitoring, lead classification and scoring, AI voice and chat agents, and smart lead routing. The service integrates with email providers (Gmail, Outlook), Shopify stores, and other third-party platforms.

3. Account Registration

• You must provide accurate, current, and complete information during registration
• You are responsible for maintaining the security of your account credentials
• You must be at least 18 years old to use the service
• One person or entity may not maintain more than one free account
• You are responsible for all activity that occurs under your account

4. Acceptable Use

You agree not to:

• Use the service for any unlawful purpose or in violation of any applicable laws
• Attempt to gain unauthorized access to any part of the service
• Use the service to send spam, unsolicited messages, or misleading communications
• Interfere with or disrupt the service or servers connected to the service
• Reverse-engineer, decompile, or disassemble any part of the service
• Use the service to process data you do not have the right to process
• Resell, sublicense, or redistribute the service without written permission

5. Payment and Billing

• The Free plan is available at no cost with limited features
• Paid plans are billed monthly in advance via credit card through Stripe
• Prices are listed in USD and do not include applicable taxes
• You may upgrade, downgrade, or cancel your plan at any time
• Downgrades take effect at the end of the current billing period
• We reserve the right to change pricing with 30 days notice
• Refunds are issued at our discretion for billing errors or service failures

6. Data and Privacy

Your use of the service is also governed by our Privacy Policy. You retain ownership of all data you provide to the service. By connecting your email and Shopify accounts, you grant us permission to access and process that data solely for the purpose of providing the service.

7. Intellectual Property

The Leadfrack platform, including its software, design, text, graphics, and logos, is owned by Pixel Pantry Technology, Inc. and protected by intellectual property laws. You may not copy, modify, or distribute any part of the service without written permission.

8. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted service. We may perform maintenance, updates, or modifications that temporarily affect availability. We will make reasonable efforts to provide advance notice of planned downtime.

9. Termination

• You may cancel your account at any time through your account settings
• We may suspend or terminate your account for violations of these terms
• Upon termination, your right to use the service ceases immediately
• We will retain your data for 30 days after termination, after which it will be deleted
• You may request an export of your data before account deletion

10. Limitation of Liability

To the maximum extent permitted by law, Pixel Pantry Technology, Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising out of or related to your use of the service. Our total liability shall not exceed the amount you paid for the service in the twelve months preceding the claim.

11. Disclaimer of Warranties

The service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be error-free, secure, or available at all times.

12. Dispute Resolution

Any disputes arising from these terms or your use of the service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in Indiana, USA. You agree to waive any right to a jury trial or to participate in a class action.

13. Governing Law

These terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.

14. Changes to Terms

We may update these Terms of Service from time to time. Material changes will be communicated with at least 30 days notice via email or a notice on the platform. Continued use of the service after changes take effect constitutes acceptance of the revised terms.
